The Madhya Pradesh High Court has declared the ancestral property of Bollywood actor Saif Ali Khan and his family worth Rs 15,000 crore as 'enemy property'. After this decision of the court, the right over the property of Saif Ali Khan and his family has ended. This property will now be under the control of the Government of India.
The Madhya Pradesh High Court has given a big blow to Saif Ali Khan and his family by declaring his ancestral property worth Rs 15,000 crore as 'enemy property'. The court repealed the 2000 decision of the trial court, in which Saif Ali Khan, his mother Sharmila Tagore and sisters were considered heirs to the property of Bhopal Nawab Hamidullah Khan. Now the hearing of this case will be done afresh in the trial court and will have to be completed within a year.
This property is related to the last Nawab of Bhopal Hamidullah Khan, who died in 1960.
The Nawab had three daughters—Abida Sultan (who went to Pakistan), Sajida Sultan (Saif's maternal grandmother) and Rabia Sultan.
Due to Abida Sultan moving to Pakistan after Partition, the Government of India declared these properties as 'enemy property' under the Enemy Property Act.
Under this law, the properties of those who moved to Pakistan or China at the time of Partition come under the control of the Government of India.
The High Court has cancelled the old order of the trial court and directed a fresh hearing of the case.
The court said that the succession of the property should be decided under Muslim Personal Law.
Saif Ali Khan and his family's petition challenging the government's order declaring the properties as 'enemy property' was rejected.
Now the case will be heard in the trial court within a year. For now, Saif Ali Khan and his family will no longer have rights over the property worth Rs 15,000 crore and it will remain under the control of the Government of India.
